Welcome to Forage Feed, the recipe platform designed to make plant-based recipes easy to create, discover and share.

Forage Feed (the “Website”) grants you the right to access and use the Website, subject to the terms and conditions of use (“Terms”) as set forth below. Please ensure you read these Terms carefully.

By accessing and using the Website, you agree to be bound by these Terms, our Privacy Policy, Submission Guidelines in addition to maintaining compliance with any applicable laws and regulations.

Amendment

Forage Feed may revise these Terms for its Website, at any time, without notice and the amended Terms will automatically be effective. Your continued access to the Website, Services and Content will constitute your acceptance of any changes to the Terms.

Service

Forage Feed allows you to publish content (the “Services”), including but not limited to, plant-based recipes, comments, external website links, meal plans, grocery lists and images (the “Content”).

By publishing Content on Forage Feed, you represent and warrant that you have all the rights and necessary authority to grant the usage rights to Forage Feed for any Content that you submit. You retain all ownership rights of and are solely responsible for the Content you publish on Forage Feed, and for any consequences thereof, including the use of your Content by other users.

Forage Feed is not responsible and assumes no liability for Content you publish, and reserves the right, at all times and for any reason, to modify, remove or refuse to distribute any Content that you provide through the Services.

You agree that Forage Feed will not be liable for any modification or removal of any Content.

Site Content

Forage Feed owns and operates the Website and Services. The Content available on the Website is the property of Forage Feed and its registered users and is protected by international copyright laws. You may access the Website, Services and Content solely for your own personal, noncommercial use.

Any unauthorised reproduction, modification or distribution of any Content is strictly prohibited, without express written consent by Forage Feed.

User Account

In order to access some of the Website’s Services, you will need to create an account (“Account”).

In creating an Account, you represent that you are of legal age to form a binding contract, or have consent by your legal guardian, under the laws of Australia or other applicable jurisdiction.

In creating an Account, you agree –

a) to grant Forage Feed permission to store your information, to the extent needed to provide the Services; and

b) to provide true, accurate and complete information about yourself as outlined in the Forage Feed Registration Form, (“Your Account Data”); and

c) to maintain Your Account Data to ensure it is true, accurate and complete information about yourself.

If Forage Feed has reasonable grounds to suspect that Your Account Data is untrue, inaccurate or incomplete, Forage Feed reserves the right to suspend or terminate your Account without notice.

When you create an Account, you will nominate a unique username and password (“Login Credentials”). You are responsible for maintaining the confidentiality of your Login Credentials, and for all activities that occur under your Account.

You agree to notify Forage Feed immediately of any breach to security, or any unauthorised use of your account. If Forage Feed reasonably determines that Your Account may have been used by an unauthorised third-party, Forage Feed reserves the right to terminate or change your Login Credentials.

Forage Feed is not liable for any losses caused by unauthorised use, suspension or termination of Your Account.

Your Conduct

You agree that by accessing the Website and publishing Content, you agree not to use, or to encourage others to use the Website to:

a) Make available any Content that could reasonably be defined as unlawful, antagonistic, harmful, sexually explicit or discriminatory in nature.

b) Make available any Content that infringes any intellectual property right of any party.

c) Impersonate any person or entity, or falsely misrepresent your affiliation with a person or entity.

d) Push any content or engage in any conduct which could reasonably be defined as spam, including but not limited to any duplicative or unsolicited messages.

e) Access or attempt to access any Content that you are not authorised to access, or could interfere with the security of, the Website, the Content, resources, Accounts, Login Credentials.

f) Market any goods or services for any business purposes, unless otherwise agreed to in writing by Forage Feed.

g) Reproduce, sell, trade or exploit for any commercial purposes, any portion of the Website of Content is strictly prohibited, without express written consent by Forage Feed.

Ownership Rights

You retain all ownership rights in, and are solely responsible for the Content you publish on Forage Feed.

Forage Feed is not responsible and assumes no liability for Content you or any registered users publishes on or through the Website. However, by publishing Content on Forage Feed, you hereby grant Forage Feed a worldwide, non-exclusive, royalty-free, transferable, sub licensable licence to display, use, distribute, reproduce, prepare derivative works of and modify, in whole or in part, on the Website or in connection with Forage Feed’s businesses.

Copyright

Forage Feed respects the intellectual property rights of others.

Forage Feed will use all reasonable efforts to investigate notices of alleged infringement and take appropriate action, where deemed necessary. In appropriate circumstances and at our discretion, this may include removing Content or disabling access of accounts of users who repeatedly infringe on intellectual property rights.

While Forage Feed strives to display Content from trustworthy sources, Forage Feed assumes no liability and is not responsible for screening and/or verifying that the Content provided using the Service is accurate, reliable or safe. You understand and acknowledge that you access and use the content published on Forage Feed at your own risk.

The Forage Feed website may contain content, including recipes, that may focus on specific diets or certain medical conditions. This content is provided for entertainment purposes only, and are not intended to be, and does not constitute, for dietary, nutritional, medical, or food safety advice. Termination

Forage Feed may suspend or terminate your right to access or use the Website or Service without notice, for any reason, including a violation of the Terms, Submission Guidelines or Copyright Infringement.

Following the termination or deactivation of your account, if you remove any Content from Forage Feed, we may keep your Content for a reasonable period of time for backup, archive or audit purposes. Forage Feed and other users may retain and continue to use, store, display, reproduce, modify and create derivative works of your Content.

You agree that Forage Feed will not be liable to you or to any third-part for any termination of any Content, or the discontinuation of the Website.

Indemnity

Limitation of Liability

To the maximum extent permitted by applicable law, Forage Feed and its affiliates, employees, representatives and directors will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, any damages for personal or bodily injury, or other intangible losses, resulting from –

a) your access to or use of or inability to access or use the Service;

b) any conduct or Content of any third-party on the service, including but not limited to, any defamatory, offensive or a legal conduct of other users or third parties;

c) any Content obtained from the Service;

d) unauthorised access, use or alteration of your Content.

General Provisions

In the event that any provision of these Terms is, for any reason, held to be invalid or unenforceable, the remainder of the Terms will remain valid and enforceable to the maximum extent permitted by law.
